Special Naturalization

Special Naturalization (reinstatement of nationality)
General requirements
  • Must have good conduct
  • Must have basic knowledge befitting a Korean national; such as understanding of the Korean language, customs and culture
Additional requirements (Nationality law, Article 7, Section 1, subsection 1)

- Foreigners that meet general requirements and also apply to the following:

  • Foreigners whose either parent is of Korean nationality, except foster children who were adopted after they have become adults according to the Korean civil law
  • Special naturalization for Korean Chinese
  • Korean-Chinese born after October 1st 1949 are considered to have Chinese parents at birth. Therefore, such Korean-Chinese are eligible for limitless reinstatement of their Korean nationality regardless of their age, time spent in Korea, or ability to support themselves, through special naturalization if:
    - Ether parent is reinstated their Korean nationality
    - Either parent has applied for restoration of their Korean nationality with full intention of becoming a Korean national.
  • Should the 1st-generation parent of the accompanied 2nd-generation Chinese apply for Korean nationality but dies before it had been granted,
    - The parent’s reinstatement of Korean nationality is automatically cancelled; thus cancelling all accompanied applications.
    - However, 2nd generation Chinese are still eligible for naturalization as children of a former Korean national upon continued residence in Korea for more than 3 years.
  • 2nd generations are granted naturalization after accompanied 1st generations documents are processed. Therefore, their permissions are granted after the 1st generations’.

  • - Items subject to change depending on individual circumstances.
    - Documents written in foreign languages need to be translated in Korean and notarized. Notarization will be exempted only for English and Chinese. (In this case, you must record name and contact number of translator.)

  • A copy of the passport : Must present the original when submitting copy

  • The original copy of Chinese resident certificate
  • The original copy of Chinese population certificate
  • Documents that verify their relationship with 1st generations as their children
    - Birth certificate, Chinese family relationship certificate (must be certified by the Ministry of foreign affairs)
    - Childhood photos or recent photos taken with the first generations
    - Other Chinese public documents (Population certificate with the whole family etc)
  • Proving documents of parents, spouse, children, marriage status or adoption of person who applied for naturalization
  • Documents issued by government of People's Republic of China proving the person who applied for naturalization is Korean Chinese when his/her name is written in Korean pronunciation not in Chinese pronunciation
  • In case that the person who applied for naturalization specifies the date of birth newly, a certificate proving this fact issued by Embassy or consulate's office of their original country.
