The Public Defender System for Victims

Overview

The Public Defender System for Victims provides legal support by assigning government-appointed attorneys to victims of sexual crimes, crimes of child abuse, abuse of persons with disabilities, human trafficking, and crime of stalking. These attorneys offer professional legal assistance throughout the entire criminal procedure, from the initial stage of the incident through investigation and trial.

Eligible Groups

Victims of sexual violence, child abuse, abuse of the disabled, human trafficking, stalking crimes, and children/adolescents who are victims of sex trafficking.

Assistance Provided during the Investigation Stage

？ Explaining to the victim how to participate in the investigation process and providing guidance on how the attorney, a trusted companion, or a statement supporter will assist them.

？ Submitting opinions after the investigation to ensure that the victim's statement is sufficient to prove the constituent elements of the crime.

？ Drafting and submitting written opinions to the investigative agency, detailing the facts of the crime and evidence based on consultation with the victim.

？ Taking necessary measures for victim protection, such as preventing the victim's personal information from being exposed through records, evidence, or the media, and preparing for the risk of retaliation.

Assistance Provided during the Trial Stage

？ Attending the public trial date to grasp the flow of the case and convey this information to the victim.

？ Collecting evidence for sentencing and impeachment, preparing and submitting opinions to the court based on this evidence, and striving for appropriate punishment for the defendant.

How to Apply

？ Application Method : The crime victim or their legal representative may verbally or in writing request support from a state-appointed attorney for victims when reporting the crime to investigative agencies such as the police station or prosecutor's office.

？ Alternative Application : Support can also be requested through sexual violence counseling centers or specialized child protection agencies.
