Granting of Status of Stay
  • Giving permission to stay in Korea to a foreigner who is currently in Korea without any such permission.
Eligibility
  • Former Koreans who lost/gave up their Korean nationality
  • Newborn child born in Korea who has foreign parents
  • Other foreigners who are currently in Korea without status of stay
Application Period
  • Applicant must apply within 30 days of whatever incident that required him/her to apply for the change.
  • Newborn child born in Korea must apply within 90days.
  • Failure to apply within 30 or 90 days will result in fines as outlined by the Immigration Act.
  • A departing foreigner as an applicant of granting of status of stay is able to depart without granting of status of stay with 30 days from the time of reason.
How to apply
  • Present the required documents (details listed below) to the local Immigration Office (may be applied by an appointed agent)
How the status is determined:
  • Children of a foreigner with Diplomacy (A-1), Official Business (A-2), or Convention/Agreements (A-3) status who were born in Korea
    - Identical status as their parent.
  • Children of a registered foreigner who were born in Korea
    - In general, Dependant Family (F-3) status
  • Children under 20 of a foreigner with Permanent Residence (F-5) status
    - Permanent Residence (F-5) status
  • Spouse of a foreigner with Permanent Residence (F-5) status who gave up Korean nationality and assumed the spouse's nationality instead.
    - Residency (F-2) status
  • Former U.S. troop who were discharged from service while being stationed in Korea
    - Convention/Agreements (A-3), Short-term Visit (C-3), Family Visitation (F-1), Residency (F-2), or Miscellaneous (G-1) status
  • Children of a foreigner with Residency (F-2) status who were born in Korea.
    - Family Visitation (F-1) status
  • Children of a foreigner with Industrial Training (D-3) or Nonprofessional Employment(E-9) status who were born in Korea
    - Family Visitation (F-1) status
